These Terms of Service (the “Terms”) govern your access to and use of The CiGodfather (the “Lounge,” “we,” or “us”), an online members’ cigar lounge. By creating an account, becoming a member, or otherwise using the Lounge, you agree to these Terms. If you do not agree, please do not use the Lounge.
The Lounge is intended solely for adults with an interest in premium cigars and the culture surrounding them. You may use the Lounge only if you are at least 21 years of age (or the legal age for tobacco products in your jurisdiction, if higher) and able to form a binding contract. The Lounge is not directed to anyone under the legal age, and we do not knowingly permit them to register. By using the Lounge you confirm that you meet these requirements.
The Lounge offers conversation, education, community, and entertainment about cigars and the lifestyle around them. We do not sell, ship, or supply cigars, tobacco, or any physical goods through the Lounge.
To take part you create an account and may choose a lounge name. You are responsible for the activity under your account and for keeping your access to it secure. Please give accurate information and keep it current. One person may not maintain multiple accounts to evade limits or suspensions, and you may not share your membership with others.
Some features of the Lounge are free; others are available only with a paid membership, a Premium upgrade, or a one-time purchase. All payments are processed by our payment processor, Stripe. We currently offer:
By starting a paid membership or Premium subscription, you authorize us, through Stripe, to charge your chosen payment method on a recurring basis until you cancel. By purchasing a single Smoke session, you authorize a one-time charge for that purchase only; it does not renew or recur.
Recurring plans renew automatically at the end of each billing period unless you cancel before they renew. We may change prices or features from time to time; we will give reasonable advance notice of any price increase, and the new price will apply to your next renewal. Cancellation and refunds are governed by our Cancellation & Refund Policy, which forms part of these Terms.
The “Cigar Don” is an artificial-intelligence persona, not a real person, and his replies are generated automatically by software. His conversation is offered for general interest, education, and entertainment only.
AI-generated content can be incomplete, out of date, or simply wrong. Nothing the Cigar Don says is professional advice of any kind — it is not medical, health, legal, financial, or safety advice, and you should not rely on it as such. Cigars and tobacco carry real and serious health risks; we make no health claims and encourage you to make your own informed decisions and to consult qualified professionals where appropriate. Verify anything important independently before acting on it.
The Lounge is a civil, members’ room. When you use it — including in any shared rooms, messages, or content you submit — you agree not to:
You keep ownership of the messages, photographs, and other content you submit. By submitting content, you grant us a non-exclusive, worldwide, royalty-free licence to host, store, display, and use it as needed to operate and provide the Lounge to you and, where you choose to post in shared rooms, to other members. You are responsible for the content you submit, and you confirm you have the rights to share it. We may remove content or limit features at our discretion, particularly where content breaches these Terms.
The Lounge, its design, the Cigar Don persona, and the text, graphics, and software that make it up are owned by The CiGodfather or its licensors and are protected by intellectual-property laws. We grant you a limited, personal, non-transferable, revocable licence to use the Lounge for your own enjoyment in accordance with these Terms. You may not copy, resell, or commercially exploit the Lounge or its content without our written permission.
You may stop using the Lounge at any time and may cancel a paid membership as described in our Cancellation & Refund Policy. We may suspend or terminate your access — with or without notice — if you breach these Terms, if we are required to by law, or if we discontinue the Lounge. If we terminate your paid membership without cause, your sole remedy is described in the Refund Policy.
The Lounge is provided “as is” and “as available,” without warranties of any kind, whether express or implied, to the fullest extent permitted by law. We do not warrant that the Lounge will be uninterrupted, error-free, secure, or that any content (including AI-generated content) is accurate or reliable.
To the fullest extent permitted by law, The CiGodfather and its operators will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising from your use of the Lounge. To the extent we are found liable, our total liability to you for any claim relating to the Lounge will not exceed the greater of the amount you paid us in the twelve months before the claim or US$100. Some jurisdictions do not allow certain limitations, so some of these may not apply to you.
You agree to indemnify and hold harmless The CiGodfather and its operators from any claims, losses, and expenses (including reasonable legal fees) arising out of your content, your use of the Lounge, or your breach of these Terms.
We may update these Terms from time to time. When we make material changes, we will update the date above and, where appropriate, notify you within the Lounge or by email. Your continued use after changes take effect means you accept the updated Terms.
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict-of-laws rules. The courts located in Ontario will have jurisdiction over any dispute, except where applicable law gives you the right to bring proceedings elsewhere.
